Don’t forget Rule 191 … You MUST NOT overtake the moving vehicle nearest the crossing or the vehicle nearest the crossing which has stopped to give way to pedestrians.

Overtaking on a pedestrian crossing is so dangerous, the 20mph is danger as more vehicles overtake anyone doing 20mph. Ive had 4 cars overtake me in a 20mph 75% dont know or dont care and refuse to do 20

Biker conveniently leaves out the footage of what happened leading up to this, and it would be very foolish to just blindly take his word for it, especially given how he’s behaving in the footage that we do have.

Just to be clear I am not defending the van driver’s actions, but just remember that whenever you see dashcam/GoPro clips like this with the context removed it’s always for a reason. If someone rides/acts like an asshole I find it hard to regard them as a victim in any instance.

In regard to the pheasant incident: I read in the legal column of a popular British motorbiking magazine a couple of years ago a letter from a biker who had gone into the back of a car which had stopped suddenly to avoid hitting a squirrel. The driver was found not to be liable for the damage caused to the bike because avoiding the animal was a good reason, apparently. Assuming that the squirrel was a grey, not a red (a protected species in the UK), it should surely not be a good reason as grey squirrels are vermin, an invasive species and if caught in a trap it’s illegal to release it. But it’s odd that the biker is found liable here and not when the animal in question is a pheasant which is someone’s property (albeit kept to be shot).

I was once doing a driving assessment (in an artic) for a trucking company and I took evasive action (can’t remember what, probably just waiting for it to cross) to avoid squashing a squirrel. The guy assessing me said “it’s a rat! It’s just a rat with a bushy tail!”.

Completely disagree. If the motorcyclist had allowed more space and time before following behind the van, it wouldnt have happened. Let alone both of them gobbing off at each other. This should be a 50/50 case, as both parties are engaging in road rage. The motorcyclist failed to pull away at a GREEN light. He was obstructing the road to engage in road rage. The van, quite legitimately overtook the obstruction, as is completely legal – and then he stopped. I don’t actually think it was a brake check, I think he was intending to be a knob and obstruct the road for the biker. 50/50 all day. Two plonkers

Whilst it was clearly the van driver that should be held liable, the motorcycle is also a bungalow.

He was clearly antagonising the driver and also wearing no protective clothing other than a helmet.

If he had come off the bike at anything other than walking speed, skin and muscle would have been ripped off his bones and it does not grow back.

I am sorry if that is a distressing image but if it saves one person from suffering such a fate then I am afraidy your discomfort is a trade off I feel I must make.

Don’t agree with outcome and insurers are a law unto themselves. Unless challenged in a court of law insurers will agree whatever they want. Insurers after all will never or virtually never be the losers in the long run. Insurers mitigate risk, end of story. That Motorcyclist could have declined to engage. And followed to close to brake checking van. It should have been 50-50 for brake checking van although he probably didn’t challenge the ( van driver) outcome.

It is quite right that the van driver was held fully accountable, but the biker was a fool for carrying on the primary school playground insults and not anticipating the brake check. What he should have done is simply send the footage of the alleged original pull-out to the police and say nothing to the van driver. If somebody overtakes like that following an altercation, their intention is obvious, so hang back.

I can’t believe that someone who braked to avoid hitting a pheasant was found liable for getting hit in the rear. The following vehicle shouldve left sufficient braking distance. Doesn’t matter whether its a pheasant, frog or female. There should be sufficient distance should the vehicle in front need to brake unexpectedly.

Fascinating case. While the van clearly brake checked the bike and was correctly found liable, the motorcyclist clearly drove into the back of the van through his own volition; I suspect the motorcyclist realised he had antagonised the van driver to the point where the driver was going to get out his van and there as going to be a direct confrontation, and the motorcyclist decided to escape the situation by riding around the van and leaving the area pronto. But he lacked the competence to accelerate and steer simultaneously so he ploughed into the van instead. You can hear from the throttle note and the change of gear that the motorcyclist was not attempting to bring his bike to a halt but instead to drive off.

Case of two bad drivers. The way the motorcyclist accelerated, he was clearly trying to race the van driver.
I’d like to see both prosecuted, but the van driver is 100% liable for collision, has a much bigger share of fault and has more responsibility with the hierarchy of road users.

Had similar off a van driver one morning going into work. Guy overtook me pretty close on right before going up a railway bridge. My words were basically a loud “whoa!” as he then slammed on hard in front of me. He leaned out giving me a load of abuse, I walk around to his drivers window to ask for his details (caught my right brake too). He’s then calling me a “fa^^ot” and “clown”, just no reasoning with him so I walked off and fixed my brake with my multitool at the side of the road. Got home that evening, reported him to the police – no footage on the camera (not sure why). Police refused to do anything. A year later I see driver’s face in the paper – convicted of beating a man with a hammer with his son (I presume it was his son in the cab with him).

This van driver is just a douche and a numpty!! I don’t really understand why some people have to road rage? It doesn’t take you anywhere and more often than not it will get you into big trouble! 😵‍💫😵‍💫 Personally, just let it go and go in your way!
